Amendments to the Railways Act

31. Amendment of Sec.3.-In Sec. 3 of the Railways Act, after Cl.(18) the following clauses shall be inserted, namely :

    (19) "Claims Tribunal" means the Railway Claims Tribunal established under Sec. 3 of the Railway Claims Tribunal Act, 1987.

32.Amendement of Sec. 78-A.- In Sec. 78-A of the Railways Act, for the word "suit" the words "application before the Claims Tribunal" shall be substituted.

33.Substitution of new section for Sec 80.-For Sec. 80 of the Railways Act, the following section shall be substituted, namely :

        "80. Application for compensation.- An application to the Claims Tribunal for compensation for loss of the life of, or personal injury to, a passenger or for loss, destruction, damage, deterioration or non delivery of animals or goods may be made,-

            (a) if the passenger was, or the animals or goods were, booked from one station to another on the railway of the same railway administration, against that railway administration;

            (b) if the passenger was, or the animals or goods were, booked, through over the railway of two or more railway administrations against the railway administration from which the passenger obtained his pass or purchased his ticket or to which the animals or goods were delivered for carriage, as the case may be, or against the railway administration on whose railway the destination station lies, or the loss, injury, destruction, damage or deterioration occurred."

34. Omission of Secs. 82-B, 82-D and 82-F.-Sections 82-B, 82-D and 82-F of the Railways Act, shall be omitted.

35. Amendment of Sec.82-C.-In Sec. 82-C of the Railways Act,

       (a) in sub-section (1) for the words "Claims Commissioner", the words "Claims Tribunal" shall be substituted;

        (b) sub-section (2) and the explanation thereto shall be omitted.

36. Amendment of Secs. 82-E, 82-G and 82-HH.-In Secs. 82-E, 82-G and 82-HH of the Railways Act, for the words "Claims Commissioner", wherever they occur, the words "Claims Tribunal" shall be substituted.

37. Amendment of Sec.82-I.-In Sec.82-I of the Railways Act, for the words, figures and letters "Secs. 82-A to 82-HH", the words, figures and letters "Secs. 82-A, 82-C, 82-E and 82-G to 82-HH" shall be substituted.

38. Amendment of Sec.82-J.-In Sec.82-J of the Railways Act-

            (a) in sub-section (1), for the words, figures and letters "Secs. 82-A to 82-H inclusive", the words, figures and letters "Secs. 82-A, 82-C. 82-E. 82-G and 82-H" shall be substituted :

            (b) in sub-section (2),Cl. (i) and Cls. (iv) to (vi) shall be omitted.
